Contesting a Citation

Pursuant to California Vehicle Code Section 40215(A) the following steps must be taken in order to contest a parking citation.

STEP 1

If you received a parking citation and believe that it was issued in error you may request an Initial Review. You have twenty-one (21) days from the date the citation was issued, or within fourteen (14) days from the date the Notice of Illegal Parking was mailed to contest the citation. This request may be made by telephone, in writing, or in person. Failure to contest the citation in the required time frame will result in you losing all rights to further contest the citation.

This form may be requested from the issuing agency, from the Citation Processing Center or you may download the Parking Citation Initial Review Form. When contesting a parking citation, clearly explain why you believe the citation was issued in error. Include relevant information you believe supports your claim; include copies of any supporting documents, witness statements and photographs. Please note that any documents submitted will not be returned to you nor will copies be provided for you.

You will be notified of the Initial Review results by mail once the review determination has been completed.

The Notice of Illegal Parking will be mailed to the registered owner on record with the Department of Motor Vehicles. It is the responsibility of the vehicle owner to maintain their current address with the DMV, CVC 4159.

STEP 2

If you disagree with the results of the Initial Review you may request an Administrative Hearing within twenty-one (21) days following the mailing of the results of the Initial Review. This request may be made by telephone, in writing, or in person. You must include a deposit for the full amount due. If you are unable to deposit the full amount due, you must provide satisfactory evidence of your inability to pay the amount due. You may request a hearing by mail or in-person. You will be notified by mail of the scheduled date and time for your Administrative Hearing.

You will be notified of the Administrative Hearing results by mail once the determination has been rendered.

STEP 3

If you disagree with the results of the Administrative Hearing you may seek review by filing an appeal to be heard by the Superior Court in the County where the citation was issued. A copy of the notice to appeal shall be served in person or by first-class mail by the person requesting the appeal to the Issuing Agency. This appeal must be made within thirty (30) days following the results of the Administrative Hearing.

The fee for filing the notice of appeal is twenty-five dollars ($25). The court will request that the processing agency’s file be forwarded to the court within fifteen (15) days of the request. The court will notify you of the appearance date by mail or personal delivery. The court will retain the twenty-five dollar ($25) fee regardless of the outcome of the appeal. If the court’s decision is in your favor the amount of the fee shall be reimbursed to you by the Issuing Agency and any deposit of parking penalty that has been deposited in accordance with the judgment of the court.
